1. Acceptance of Terms
By creating an account or using VaryOrder, you agree to these Terms of Service. If you are using VaryOrder on behalf of a business, you represent that you have the authority to bind that business to these terms.
If you do not agree to these terms, do not use the service. We may update these terms from time to time — we'll notify you by email for material changes.
2. Description of Service
VaryOrder is a web-based software-as-a-service (SaaS) platform that helps construction builders and contractors create, send, and manage variation orders (also known as change orders). The service includes AI-assisted drafting, digital client sign-off, and automated PDF generation.
VaryOrder is a tool to facilitate documentation. We do not provide legal, accounting, or construction advice. The legal validity of any variation order depends on the laws of your jurisdiction — you are responsible for ensuring your documents meet local requirements.
3. User Accounts
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@varyorder.com if you suspect unauthorised access.
One account may be used by one person. Team plan subscribers may add additional team members up to their plan limit.
4. Acceptable Use
You agree not to:
- Use VaryOrder for any unlawful purpose or to facilitate fraud
- Forge or misrepresent client signatures or approvals
- Attempt to access other users' data
- Reverse engineer or copy the software
- Use automated scripts to abuse or overload the service
- Resell or white-label the service without written permission
We reserve the right to suspend or terminate accounts that violate these terms without notice.
5. Payment and Billing
Paid plans are billed monthly or annually through Paddle. Prices are displayed in USD and may vary based on your location due to local taxes.
Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your Settings page — cancellation takes effect at the end of your current billing period.
We do not offer refunds for partial billing periods, except where required by law. If you believe you were charged in error, contact us within 14 days.
6. Intellectual Property
VaryOrder (the software, design, and brand) is owned by VaryOrder and protected by copyright and other intellectual property laws.
Your data — including your projects, variation orders, and client information — belongs to you. You grant us a limited licence to store and process your data solely to provide the service. We do not claim ownership of your content.
7. Limitation of Liability
VaryOrder is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that any particular variation order will be legally enforceable in your jurisdiction.
To the maximum extent permitted by law, our liability for any claim arising from your use of VaryOrder is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities.
8. Termination
You may stop using VaryOrder and delete your account at any time. We may suspend or terminate your account if you violate these terms or if required by law.
Upon termination, your data will be retained for 30 days before permanent deletion, giving you time to export any records you need.
9. Governing Law
These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of New South Wales, Australia, unless local consumer protection laws in your country require otherwise.
